What a PIP Claim Covers After a Massachusetts Car Accident

What a PIP Claim Covers After a Massachusetts Car Accident

A few days after a crash, the same questions come through our phone line. Who pays for this visit? Do I need the other driver's insurance? What happens if I have health insurance too? The answers are more straightforward than most people expect, because Massachusetts built a specific system for exactly this situation. It is called Personal Injury Protection, or PIP.

I have treated car accident patients in Cambridge for more than 40 years, and my office handles PIP billing every week. This post explains how the coverage works in plain English. It is not legal advice, and I am not an attorney. For questions about fault, settlements or a lawsuit, talk to a lawyer. For questions about how your care gets paid for, read on.

Massachusetts Is a No-Fault State

No-fault means that after a crash, your own auto insurance pays for your initial medical care and related losses, regardless of who caused the collision. You do not have to wait for the two insurers to argue about fault before you can see a doctor. PIP is the part of your policy that does this, and every Massachusetts auto policy is required to carry it.

Three points people often get wrong:

  • PIP is on your own policy, not the other driver's. If you were driving your car, your insurer pays. If you were a passenger, the policy on the car you were in usually applies. If you were a pedestrian struck by a vehicle, the PIP on that vehicle generally covers you.
  • It applies even if the crash was your fault. Rear-ended someone on Memorial Drive on black ice? Your PIP still covers your care.
  • The standard limit is $8,000 per person per accident. That is the amount every policy must carry. Some people buy more coverage, and it is worth checking your declarations page.

What PIP Pays For

PIP covers three categories of loss, all of which share the same $8,000 pool:

  1. Reasonable and necessary medical expenses. Emergency room visits, urgent care, imaging, physician visits, physical therapy and chiropractic care. Chiropractic is explicitly covered; it is not a gray area.
  2. Lost wages. PIP replaces 75 percent of your lost income if a doctor documents that you cannot work because of the injuries. If you have sick pay or disability coverage through work, that usually applies first.
  3. Replacement services. If you have to pay someone to do things you normally do yourself, such as cleaning, childcare or snow removal, PIP can reimburse those costs.

The $2,000 Rule When You Have Health Insurance

This is the part that confuses almost everyone, so I will be concrete. If you have health insurance, PIP pays the first $2,000 of your medical bills. After that, your health plan is billed for your care. PIP then steps back in to pay what the health plan does not, meaning copays, deductibles and services the plan denies, up to the $8,000 limit.

If you do not have health insurance, or your plan is one that does not coordinate this way, PIP pays your medical bills directly up to the full $8,000. Lost wages and replacement services are not subject to the $2,000 handoff; they come straight from PIP.

The $2,000 figure matters for one more reason. In Massachusetts, one of the conditions for bringing a pain-and-suffering claim against the other driver is that your reasonable medical expenses exceed $2,000, unless the injury falls into a specific category such as a fracture or permanent disfigurement. That is a legal question, and the place to take it is an attorney, not my office. I mention it only because people are surprised to learn that the care they receive and the records that document it are connected to that threshold.

Deadlines and Paperwork

Notify your insurer promptly after the crash, ideally the same day. They will open a claim and give you a claim number. You will then complete a PIP application, which asks about the accident, your injuries, your health insurance and your employer. Massachusetts gives you two years from the date of the accident to file a PIP claim, but waiting that long creates problems I will cover below. Your insurer may also ask you to attend an independent medical examination; that is normal, and you should go.

Optional MedPay

Medical Payments coverage, usually called MedPay, is an optional add-on that extends medical coverage beyond PIP. If you carry it, it can pay bills once PIP is exhausted or cover costs PIP and your health plan leave behind. Check your policy; many people have it and do not know.

How a Chiropractor Fits Into a PIP Claim

The insurer's standard is "reasonable and necessary." My job is to make the care both of those things, and to document it so the adjuster can see it. In practice that means:

  • An evaluation on the first visit. History of the crash, a physical exam with orthopedic and neurological testing, and imaging referrals when the exam calls for them. Whiplash is the most common diagnosis, but I also see low back sprains, disc injuries, shoulder injuries from the seat belt and headaches that trace back to the neck.
  • A written treatment plan with a diagnosis, a goal and a timeline, reassessed on real progress rather than a fixed number of visits.
  • Notes for every visit, with objective findings such as range of motion and tenderness, not just "patient feels better."
  • Records sent to the adjuster and, if you have one, your attorney. Our auto accident rehabilitation page describes the full program.

What Our Office Needs From You

Bring these to the first visit, or call them in ahead of time, and the billing side takes care of itself:

  • The name of the auto insurer handling the PIP claim and the claim number
  • The date of loss (the date of the crash)
  • The adjuster's name and phone number, if you have them
  • Your health insurance card, so we can bill correctly after the first $2,000
  • The police report number, if a report was filed
  • Your attorney's contact information, if you have retained one

If you do not have the claim number yet, come in anyway. We can start care and collect the details within a few days. Our PIP insurance page covers the office side in more detail.

What Happens When PIP Is Exhausted

Eight thousand dollars sounds like a lot until an ambulance ride and an emergency room visit with a CT scan take most of it. When the PIP limit is reached, your options, roughly in order, are:

  1. Your health insurance, which continues to cover care subject to its usual copays and limits. Be aware that a health plan may later seek reimbursement from any settlement you receive.
  2. MedPay, if you bought it.
  3. The at-fault driver's bodily injury liability coverage, through a claim or a lawsuit, which is where an attorney comes in.
  4. Self-pay. We tell you before you reach the PIP cap, not after, so there are no surprise bills.

Why Delayed Care Weakens Both Recovery and the Claim

Whiplash symptoms often appear one to three days after a crash, and the natural instinct is to wait and see. From a recovery standpoint, that gives inflammation and muscle guarding time to settle in, which makes the injury slower to treat. From a claim standpoint, adjusters look at the gap between the crash and the first visit. A long gap invites the argument that the injury came from somewhere else. Early evaluation, ideally within 72 hours, protects both. I lay out the step-by-step in What to Do in the First 72 Hours After a Crash, and what the recovery itself looks like in Whiplash Recovery After a Car Accident.

The Short Version

PIP on your own policy pays for reasonable and necessary care, including chiropractic, up to $8,000, regardless of fault. If you have health insurance, PIP pays the first $2,000 and then fills in behind your health plan. Notify your insurer promptly, get a claim number, and get evaluated early. If you have been in a crash in Cambridge or nearby, call (617) 494-1166. We hold same-day slots for patients in pain and will verify your coverage before treatment so you know what you owe.
